Welcome to MyBooth. By accessing or using our platform, you agree to be bound by these Terms of Service. Please read them carefully before creating an account or using any MyBooth features.
1. About MyBooth
MyBooth is a software-as-a-service (SaaS) platform that allows individuals and businesses to create standalone product landing pages. We provide the tools and infrastructure; you provide the content and products.
2. Eligibility
You must be at least 18 years old to use MyBooth. By using the platform, you represent and warrant that you meet this requirement and have the legal capacity to enter into a binding agreement. If you are using MyBooth on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.
3. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@mybooth.com if you suspect any unauthorized access or use of your account. MyBooth is not liable for any loss or damage resulting from your failure to protect your account information.
4. Acceptable Use
You agree to use MyBooth only for lawful purposes and in a manner consistent with all applicable laws and regulations. You may not use MyBooth to:
- Sell or promote illegal, counterfeit, or fraudulent products or services
- Infringe on the intellectual property rights of any third party
- Distribute malware, spam, or any form of harmful content
- Engage in deceptive practices or misrepresent your products
- Attempt to gain unauthorized access to our systems or other users' accounts
5. Your Content
You retain full ownership of all content, images, text, and materials you upload to MyBooth ("Your Content"). By uploading content, you grant MyBooth a limited, non-exclusive, royalty-free license to host, display, and deliver Your Content solely for the purpose of operating the platform and providing services to you.
You are solely responsible for ensuring that Your Content does not violate any applicable laws, third-party rights, or these Terms. MyBooth reserves the right to remove any content that violates these Terms or applicable law without prior notice.
6. Subscription & Billing
MyBooth offers free and paid subscription plans. Paid plans are billed on the cycle selected at sign-up (monthly or annually). All fees are stated in U.S. dollars and are non-refundable except as required by law or as expressly stated in our refund policy. We reserve the right to change pricing with at least 30 days' notice to existing subscribers.
7. Service Availability
We strive to maintain platform uptime and reliability, but we do not guarantee uninterrupted, error-free service. MyBooth may perform scheduled maintenance, updates, or experience unexpected outages. We are not liable for any loss or damage resulting from downtime or service interruptions.
8. Termination
You may cancel your MyBooth account at any time from your account settings. We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion. Upon termination, your access to the platform and Your Content will be discontinued.
9. Disclaimer of Warranties
MyBooth is provided "as is" and "as available" without any warranties of any kind, either express or implied. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of Liability
To the maximum extent permitted by applicable law, MyBooth and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business, arising out of or in connection with your use of the platform — even if we have been advised of the possibility of such damages.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the United States and the state in which MyBooth is incorporated, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of that state.
12. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page and may notify you via email or in-app notification. Continued use of MyBooth after changes constitutes your acceptance of the updated Terms.
